INTRODUCTION: It is a fact that our contemporary society is going through a profound moment of social transformations caused by technology, thus establishing the 4th industrial revolution; among the products of such a moment of innovation, we have the development of Artificial Intelligence, with a potential disruptive capacity. In this scenario, where a program created by man is characterized by an autonomy of action, arises the question of how it will be classified in Law, whether as a thing, a sentient being, or whether it will be endowed with personality. OBJECTIVES: In front of this scenario, the present work was originated, with the purpose of, after delimiting the concept and methods of artificial intelligence, to determine, through comparative law, which legal treatment is given to Artificial Intelligence, to then analyze the implications arising from such attribution of legal personality, to finally study the transformation that legal postulates can undergo from such recognition. MATERIALS AND METHOD: The research was operationalized by the systemic method, which presupposes a description of the phenomena and data studied to, from hypotheses, explain in an acceptable way the reason for being of the phenomena, also deducing eventual facts resulting from what was studied; indirect documentation was used in a means of documentary and bibliographic research, on articles, books and reports published on the subject. RESULTS: At the end, it was concluded that, in accordance with the majority understanding at extranational level, it is not possible or even necessary, in the current moment of technological development, to attribute legal personality to artificial intelligence, since it does not have effective autonomy and self-determination, essential qualities when conferring legal personality to an entity. FINAL CONSIDERATIONS: Thus, at least in situations and problems related to Artificial Intelligence, currently faced by Law, traditional solutions are still capable of being used, with no need or possibility of granting legal personality to Artificial Intelligence.
